K9 Unit Investigates Burglar Alarm And Bites Woman On Lip

Case:  Lowry v. City of San Diego, Court of Appeals, 9th Circuit 2016

What happened:  Police investigating a burglar alarm in an office building let loose a police dog, and the dog bit an office worker sleeping in her office on the upper lip.

Decision:  Police may be liable even though the injuries were not too severe because the dog could easily have caused much worse injuries.  Civil liability might might useful in deterring police from exercising insufficient control over police dogs in the future.

Comment:  I question whether police really gave the warning they said that they did before letting the dog off the chain.
