Police, The Fourth Amendment, Qualified Immunity

2d Cir. Judges Walker, Katzman and Lynch think it okay for police to kill a pet dog in its home

Case: CARROLL v. COUNTY OF MONROE, Docket No. 12-975-cv (Second Circuit, March 12, 2013)

Decision: It is okay for police to kill pets in the home on a search warrant. No 4A problem.

Comment: The decision says it is tragic the dog was shot to death before the owner was allowed to restrain it and expresses some pretty wishes that police might act less barbaric in the future, but because the judges can find no legal remedy: (i) the opinion is garbage; and (ii) the judges should be ashamed of themselves.
