Judge Garaufis thinks that NYPD Officers may have made up a phantom trespasser

Case: GILLIARD v. CITY OF NEW YORK, No. 10-CV-5187 (NGG) (CLP) (E.D. New York, February 11, 2013)

Summary of the interesting part: NYPD officers Christian Allen and Kevin Costello said that they thought they saw a trespasser on the foof of a building.  The judge thinks it is possible that the officers may have made up the trespasser as an excuse to stop and search a man (who turned out not to be the trespsser if there really was one). Trial will be needed to know if the officers were lying.
