Police, The Fourth Amendment, Qualified Immunity

HUNT v. CITY OF TOLEDO LAW DEPARTMENT (N.D.Ohio 7-30-2012)

leave a comment »

Magistrate Judge Vernelis K. Armstrong decides that a no-knock, wrong-door raid by the Toledo police, and the arrest of the victims of the raid for obstruction, is acceptable under the Fourth Amendment. The wrong door raid was apparently occasioned by mistakes of Detective Eric Sweat, but Magistrate Judge Armstrong was willing to excuse these mistakes.
