Case: BROWN v. PASSMORE (11th Cir., September 19, 2011)

What allegedly happened: Police officers came into plaintiff’s house when he was sleeping inside, woke him up, searched the house, found no contraband, but, later, lied and claimed that they did recover contraband from plaintiff’s house.

Decision: Police may end up being liable here. Because the police reports had wrong information about what happened at the house there was a fact issue preventing qi on summary judgement.
